YOU SHOULD READ THE FOLLOWING TERMS & CONDITIONS OF BUSINESS CAREFULLY BEFORE USING AND ORDERING FROM THIS SITE. 

GENERAL

For the purpose of these Terms & Conditions, MIRPURI - which is our trading name - also means mirpurijewellery.com and is the same as "we", "us" or "our".

These Terms & Conditions govern your use of, and the purchase of goods through, this Site. By using this Site, you agree to comply with, and be bound by these Terms & Conditions. If you do not agree with all of these Terms & Conditions, please refrain from using this Site and leave it immediately. This Site is provided solely for your personal use and may not be used for any commercial purposes.

These Terms & Conditions, together with our current website prices, delivery details, contact details and privacy policy, set out the whole of the agreement between you and MIRPURI, in respect of the sale, purchase and use of the goods. They supersede any previous agreement or understanding in relation to the subject matter thereof. No variance of these Terms & Conditions is binding on us unless agreed by us in writing.

Nothing said by any sales person on our behalf should be understood as a variation of these Terms & Conditions or as an authorised representation about the nature or quality of any goods offered for sale by us. Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading.

We make no representation or warranty about the accuracy, completeness, or suitability for any purpose of the information and related graphics published on our website. From time to time, our Site may contain technical inaccuracies or typographic errors.

YOUR COMPLETE SATISFACTION

MIRPURI aims to completely satisfy you with our products and service. In the unlikely event that you are unhappy with your purchase, you are entitled to return the items for an exchange or refund provided our policy on Returning & Exchanging an order, as outlined below, is followed.


ONLINE SHOPPING

Every item for sale on this Site is either hand made or finished, often with the use of natural materials. Whilst every care has been taken to ensure that the photographic representation, description and specification of each product are accurate, slight variations in the actual goods may occur. Due to print/publication limitations, slight variations in appearance and representation of product size and colour may also exist. Some items may appear slightly larger or smaller than actual size due to screen defaults and photography techniques. Other items may be presented larger than actual size in order to clearly show details or smaller than actual size in order to show the entire item.

CONTRACT FOR SALE

MIRPURI contracts are made and orders accepted subject to these Terms & Conditions of business. These Terms & Conditions do not affect your statutory rights.

Presentation of any product on this site is an "invitation to treat". By placing an order through this Site, you are offering to purchase a product on, and subject to, these Terms & Conditions. All orders are subject to availability and confirmation of the order price. This Site and its contents do not form the basis for any contractual commitment between you and MIRPURI. No contract will exist between you and MIRPURI for the sale of any product unless and until MIRPURI has accepted your order by confirming the price ruling at that time, stock availability and that your payment has successfully been taken. That acceptance will be deemed for all purposes to be complete and effectively communicated to you, at the time that MIRPURI dispatches the goods you have ordered, and sends you an "Order Dispatch" email with confirmation of your payment. Our acceptance of your order brings into existence a legally binding contract between us. Only adults (i.e. persons aged 18 and over) are entitled to enter into legally binding contracts. You should not attempt to place an order with MIRPURI through the site if it might be deemed unlawful to do so. You should also be aware of any import restrictions or laws relating to the country your order is being delivered to as we cannot guarantee that the sale and the delivery of our goods is allowed for that location.

All goods offered by the company are guaranteed to meet statutory requirements, including meeting the current UK hallmarking legislation. However, the company cannot accept responsibility where goods supplied are subject to further processing or repackaging by the customer.

YOUR ORDER

Online orders from this Site are not subject to a minimum order value.

Shortly after placing an order through this Site, you will be sent an "Order Confirmation" email acknowledging receipt and the details of your order. Should you not receive such an acknowledgment from us within 5 business days, please contact our Online Boutique Service Desk at shop@mirpurijewellery.com. Please retain the "Order Confirmation" email for your records.

Acceptance of your online order, and the completion of the contract between you and MIRPURI, will take place at the time that your goods are dispatched, unless you have cancelled your order in accordance with the "Cancelling an Order" instructions set out below. Your order can only be  dispatched once MIRPURI has received payment in full, and confirmation of this will be provided in the "Order Dispatch" email that will be sent to you. Please retain the "Order Dispatch" email for your records. In exceptional circumstances, should we be unable to fulfill your order, we will notify you as soon as possible, and will refund you the original price paid. Under no circumstances will we be liable to you for any additional amount.

MIRPURI reserves the right to refuse to supply goods to any person for whatever reason. Non-acceptance of an order may be the result of, but are not restricted to, any of the following:

  • the ordered product being out of stock (Please see "Product Availability")
  • our inability to obtain full payment
  • identification of a product pricing or description error
  • failure to meet the eligibility to order criteria set out in these Terms & Conditions.

CANCELLING AN ORDER

If you realise that you have made a mistake and want to cancel your order, please contact our Online Boutique Service Desk at shop@mirpurijewellery.com within 48 hours of placing the order. As we endeavour to process orders promptly, it may not be possible to stop the authorisation of your payment and the dispatch of your goods, so please follow the "Returning or Exchanging an Order" instructions set out below in those instances. 

RETURNING OR EXCHANGING AN ORDER

This return or exchange procedure applies only to good purchased through this website.

Goods purchased online from this Site may be returned if you are not completely happy with your purchase, subject to our returns policy. 

We will guarantee a full refund, exchange or issue of a credit note if you notify MIRPURI by email using returns@mirpurijwellery.com within 7 days of the date of delivery, providing your reason for return together with the details (i.e. name, codes, credit card use) relating to the order. We will then provide you with a Return Authorisation Number (RAN) and details of where to return goods to. Refunds will only be made if the goods are returned  within 7 days of your RAN being issued, are complete and  unused, are in the original packaging, and are accompanied by proof of purchase with the RAN clearly stated on the outer packaging. MIRPURI reserves the right to inspect the returned goods before agreeing to issue a refund or a credit note. We strongly recommend that you protectively pack goods to be returned, and use either recorded or special postal delivery to ensure that you have adequate insurance cover as we cannot be held liable for any loss or damage in transit.

Any refund  given will amount to the purchase price minus the credit card and delivery charges and will only be by way of a credit to the card used to make the purchase. MIRPURI cannot refund return postage and packaging charges, nor will we refund any international sales tax or customs duties on overseas deliveries, which will remain the customer's responsibility. Only in the case of damaged, faulty or incorrectly supplied goods will MIRPURI reimburse postage and other return costs.

Please note that unidentified returns will not be refunded. Any item returned after the given time period will only be refunded at MIRPURI's  discretion.

Please note that for hygiene reasons, we cannot accept returned pierced earrings, unless they are faulty.
Exchanges are possible only if the item is available and only once the goods have been returned in a complete, unused condition in the original packaging.

This return policy does not affect your statutory rights.

PAYMENT METHODS

All payments on this Site are processed using Paypal, which accepts the following methods of payment:

Visa, MasterCard, American express, Maestro, Solo, Switch, Delta and Visa Electron.

We do not accept cash, cheques or gift vouchers as payment.

MIRPURI assumes no liability whatsoever for the availability and functionality of the PayPal payment service, nor for any financial loss caused by the use of it.

Payment in full by credit card or debit card is required before your order can be processed and dispatched. Once your payment is complete, you will be emailed a receipt for this transaction by PayPal. When your order is ready for dispatch, a further email will be sent to you using the email address you provide in your online order form, including confirmation that full payment has been received by us.

Goods supplied by us to customers remain the property of MIRPURI, until paid for in full by the customer.

By submitting an order to us through our website, you represent and warrant that the payment details provided on your order are valid and correct, and that if your order is accepted and processed by us, payment will be made in full. By placing an order, you confirm that you are the person referred to in the Billing details.

PRICING POLICY

The prices payable for goods ordered on this Site are as stated in Pounds Sterling, are free of VAT and include careful packaging in  a branded MIRPURI box, as well as delivery. You will be liable for any applicable import duties in the usual way and your local customs office should be able to help you with this. Please note that if you are purchasing goods from outside the UK, you may incur additional currency conversion and other charges by your bank/credit card company.

Although every effort is made to ensure that all prices displayed on the Site are accurate, errors may occur. If such a pricing error is discovered in respect of an item that you have ordered, we will contact you as soon as possible. You will be given the option to reconfirm your order at the correct price, or to cancel it. In the event that we are unable to contact you, the incorrectly priced portion of your order will be cancelled.

PRODUCT AVAILABILITY / INFORMATION

In the event that items you have ordered on this Site are out of stock, subject to delay, or are no longer available, we will notify you as soon as possible by contacting you at the email address or telephone number that you provide at the time of placing the order. If our attempts to contact you are unsuccessful, we will cancel the part of your order that is unavailable.

PACKAGING & DELIVERY INFORMATION

All MIRPURI jewellery comes carefully packaged in one of our sleek branded gift boxes and is delivered securely using the Royal Mail's "Special Delivery" Service within the UK, and overseas using its "Airsure" Service.

We regret that MIRPURI cannot guarantee specific delivery dates, therefore please allow for up to 7 working days for delivery within the UK and 14 working days for international deliveries from receipt of your "Order Confirmation" email. This is subject to product availability and payment clearance, and you should allow for a longer delivery time during holiday periods.  If you require goods to be delivered on a specific date, we would advise you to contact us ahead of placing an order to ensure that we are able to deliver within your preferred timescale.
 
As all pieces are hand-made / finished, orders can take from 2 to 5 weeks to be dispatched where an item is out of stock and needs to be made especially for you. You will be provided with an online tracking number which you can use to track the progress of your order.

All delivery is ex-factory, meaning that we will not be liable for damage incurred to goods in transit, delays or for non-delivery once the goods have left us and are in the possession of Royal Mail. You will become the owner of the goods you have ordered once they have been dispatched to you. Once goods have been delivered to you, they will be held at your own risk and we will not be liable for their loss or destruction.

Please note that you will be responsible for all customs and excise duties and taxes incurred in the country of destination and the liability to pay these will rest with you.

UK Deliveries:
All orders are sent out via Royal Mail Special Next Day Delivery Service delivery (excluding Saturday deliveries), and as such will need to be signed for in person. Please bear this in mind when providing a delivery address. In the event that no-one is available to receive such a Special Delivery item a card will be left providing you with the option to have the item re-delivered at a later date or to collect your parcel from your local post office collection depot.

Overseas Deliveries:
Goods are sent by Royal Mail Airsure to the following 30 destinations:

European Union Zones (Target Delivery Times : 2-4 Working Days)
Austria, Belgium, Denmark, Estonia, Finland, France, Germany, Latvia, Luxembourg, Malta, Netherlands, Portugal, Republic of Ireland, Spain and Sweden.

Non European Union Zones
(Target Delivery Times : 6 Working Days)
Andorra, Azores, Balearic Islands, Canary Islands, Corsica, Faroe Islands, Iceland, Liechtenstein, Madeira, Monaco and Switzerland

Rest of the World
(Target Delivery Times : 6 Working Days)
Australia, Brazil, Canada, Hong Kong, Malaysia, Singapore, New Zealand and USA

If your delivery has been delayed, then please contact us at: shop@mirpurijewellery.com and we will provide you with the tracking number to enable you to chase it up with the Royal Mail. We cannot refund or replace lost items until 20 working days after the date of despatch (30 days for international items) - this is when the Royal Mail classes items as being lost.

International delivery - When items are sent to another country, your parcel is often handled by more than one postal service. Unfortunately that means delivery problems are more likely. When we send a parcel abroad, the actual delivery of the item will be the responsibility of the postal service in the country the items are going to. Delays can often be caused by customs checks, which can sometimes take up to 1-2 weeks.

Items not received but tracked as being delivered - This frequently happens when items are delivered to places of work. In some cases, your item might have been delivered to a post room or colleague within your company and someone else will have signed for it. In these cases for a small charge, you can request a proof of delivery certificate from the Royal Mail (www.royalmail.com) by filling in a signature request form. Please note that we do not refund or replace items that are tracked as being delivered. For this reason, we always recommend that you get items delivered to your home address.

These materials are solely owned by MIRPURI, and in turn, by Johnny Mirpuri. Such content include, but are not restricted to, the photographs, images, illustrations, text, video clips, audio clips, designs, logos, trademarks, and other materials contained in this Site. All rights are reserved, worldwide.

The contents of this Site may not be copied, reproduced, distributed, republished, posted or transmitted in any form or by any means without the prior express written permission of MIRPURI. You may not reproduce, distribute, display, publish, modify, copy, transmit, create derivative works from, engage in any sale of or exploit in whole or in part any of the contents of the pages in this website to third parties (including, but not limited to "caching" any material on this website for access by third parties and "mirroring" any material on this website), or in connection with any business or commercial enterprise, without the express prior written permission of MIRPURI. You may print/download a single copy of the contents of any images/downloadable material on this for non-commercial use, only for the purpose of placing an order with MIRPURI while connected to the internet. JURISDICTION

Use of this Site and each and every transaction carried out through it, as well as any contract made with MIRPURI, is deemed to be completed within the United Kingdom and therefore shall be governed by and interpreted in accordance with English law. These Terms & Conditions (and any dispute, controversy, proceedings or claims of whatever nature in relation to them) shall be governed and interpreted in accordance with English law and the English courts shall have exclusive jurisdiction in relation thereto.

Any failure to enforce a right under these Terms & Conditions will not prevent us from enforcing other rights or the same type of right in the future. Unless otherwise stated in these terms and conditions, no part of these Terms & Conditions are enforceable by anyone who is not a party to them, pursuant to the Contracts (Rights of Third Parties) Act 1999.

If any sections or individual formulations of this text do not, or no longer correspond to current law, whether in part or completely, the content and validity of the remaining provisions shall remain unaffected.

We will not be in breach of our contract or otherwise liable for any delay in performance if and to the extent that any delay or failure is due to circumstances beyond iour reasonable control including, without limitation, strikes, lockouts and other industrial disputes, breakdown of systems or network access, flood, fire, explosion or accident.

If the goods we deliver are not what you ordered or are damaged or defective or the delivery is of an incorrect quantity, we shall have no liability to you unless you notify us by e-mail of the problem within 7 working days of the delivery of the goods in question.

Our liability to you for any claim or series of connected claims under these Terms & Conditions will not exceed the purchase price of goods for which the claim relates.


PRIVACY POLICY STATEMENT


At MIRPURI, we are committed to protecting your privacy and to ensuring that any information you supply to us is used lawfully (in accordance with the Data Protection Act 1998).

You will only be asked to provide information that is essential to place, process and deliver your order, or to respond to any queries raised. MIRPURI uses Paypal to safely and securely process all payments for purchases made through this Site. PayPal protects your financial information with industry-leading security and fraud prevention systems. When you use PayPal, your financial information is not shared with MIRPURI, which means that we will never have access to any of your sensitive banking and credit card details.

The only information we will typically collect and retain about you includes:

Automatically recorded information (non-personal data)
When you access the MiIRPURI website, general non-personal information (Internet browser used, number of visits, average time spent on site, pages viewed) is recorded automatically (not as part of website maintenance). This information is used to gauge our website's appeal and to improve its content and functionality. Your data is not processed any further nor is it transmitted to third parties.

SECURITY POLICY

MIRPURI employs trusted and reputable third party hosting agents and payment providers to ensure the security of personal data. All credit card / banking details that are given to us by you the customer are done so on a secure server using PayPal. The transfer of the purchase details from our site to PayPal are encapsulated using their encrypted and digitally-signed protocol. This uses a combination of standard methods to ensure that the information passed is secure and tamper-proof. Please note we do not store any of our customers' details on-line.
